SpotsWash, LLC ("Company", “us” or "We"), respects your privacy and is committed to protecting it through compliance with this policy (the "Privacy Policy").

This policy applies to any users of any of the services of the Company, including but not limited to, the Company website (https://spotswash.com) or the SpotsWash LLC mobile application (all such services referred to herein as "SpotsWash"). This policy describes the types of information we may collect from you or that you may provide when you visit SpotsWash, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy is incorporated by reference in the Term and Conditions governing the Services (the “Terms”). In connection with the Services and as provided in the Terms, SpotsWash collects and uses your personal information.  By using the Services, you agree to the terms of this Privacy Policy. From time to time, SpotsWash may update this Privacy Policy to reflect changes to its information practices. Any changes will be effective immediately upon posting of the revised Privacy Policy.

This policy applies to information we collect:

      in e-mail, text, and other electronic communications between you and SpotsWash

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you should not use SpotsWash. By accessing or using SpotsWash, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of SpotsWash after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

INFORMATION COLLECTION AND USE

Personally Identifiable Information

During your interactions with SpotsWash, such as when you register with the Mobile Application, Spotswash may collect personally identifiable information, such as your name, postal address, email address, and telephone number. We use this information to validate our users, grant access to our services, and provide targeted marketing material, service update notices, and promotional offers based on user preferences. If we need to contact you regarding Spotswash, our services, your account or your use of SpotsWash, this information may be used to contact you. If you send us e-mail, we will retain the content of the e-mail, your e-mail address, and any applicable response in order to handle any follow-up questions you may have (we may also use this information to measure how effectively we address your concerns). SpotsWash may also collect transaction details regarding your use of SpotsWash or for any contest or promotion sponsored by us, or when you report a problem with SpotsWash.

DISCLOSURES OF INFORMATION

Third Party Intermediaries

While we do not currently do so, in the future we may use a third-party entity to manage SpotsWash. In the event that we do so, this entity will be bound by a confidentiality agreement and will not retain, share, store or use personally identifiable information for any secondary purposes.

Internal Use

We may share any information collected on SpotsWash with our own internal operating units, affiliates and subsidiaries.

Outside Parties — Personally Identifiable Information

We do not currently sell, trade, or otherwise transfer your personally identifiable information to outside parties without your consent as provided herein.

Outside Parties — Non-Personally Identifiable Information (aggregated information)

We may share aggregated, non-personally identifiable demographic information with our business partners.

Legal Disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law or where we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on us.

Business Transitions

In the event SpotsWash goes through a business transition, such as a merger, being acquired by another company, bankruptcy, or selling a portion of its assets, users' personal information will, in most instances, be part of the assets transferred. Users will be notified via prominent notice on the Site. If as a result of the business transition, the users' personally identifiable information will be used in a manner different from that stated at the time of collection, users will be given choice consistent with our notification of changes section.

COMMUNICATIONS FROM SPOTSWASH

Updates

We may send all new members a welcome email. We may from time to time send email notification, cellular text, mail or call you to provide you with information concerning updates or enhancements to our service. SpotsWash may also send push notifications to your cellular device concerning our services.

Customer Service

We communicate with users on a regular basis to provide requested services, and in regard to issues relating to their account we reply via email or phone in accordance with the user's wishes.

Service-related Announcements

We may send you service-related announcements on those occasions when we deem it necessary to do so, such as if our service is temporarily suspended for maintenance. Generally, you may not opt-out of these service-related communications. If you do not wish to receive them, you have the option to deactivate your account.

VERIFYING AND UPDATING INFORMATION

Verification

When you conduct a credit card transaction with us, we use outside sources to verify a user's credit card information. We do not store your credit card information on our system.

CHANGES TO THIS PRIVACY POLICY

Generally

Our Privacy Policy is intended to provide you with a safe and secure experience. Since offerings and technologies change, we reserve the right to change, modify, add or remove portions of our Privacy Policy at any time without prior notice at our sole discretion. If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy, on the Site and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy under which the information was collected. All Privacy Policy changes are effective immediately upon posting. Consequently, you are advised to visit and review this Privacy Policy frequently for changes. The last date on which this Privacy Policy has been updated is noted above.

Regarding Use of Personally Identifiable Information

If we wish to use personally identifiable user information in a manner different from that stated in our Privacy Policy at the time of collection, we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if a user has opted out of all communication with the Site through deactivating the user's account, then the user will not be contacted, nor will the user's personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on the Site notifying users of the change. In some cases where we post a notice we will also email users notifying them of the changes in our privacy practices.

 

Data Retention Policy, Managing Your Information

We will retain Personal Information for as long as you use the Services and for a reasonable time thereafter. If you’d like us to delete user provided data that you have provided when using the SpotsWash, please contact us and we will respond in a reasonable time.

While your SpotsWash account is active, SpotsWash retains any information regarding your account unless you wish to have the account deleted and have communicated that wish to us. However, SpotsWash may retain necessary information after account deletion in the following situations:

 

      When there is an unresolved issue relating to your account, for example, outstanding credit or an unresolved dispute;

 

      When we are required to by applicable law; and/or

 

      When necessary for its legitimate business interests, such as fraud prevention, user safety, and security.

 

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees, contractors and third party service providers who need to know that information in order to operate, develop or improve the Services. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

 

Reviewing and Updating Your Information

You can review and change your personal information by logging in to Spotswash and visiting your account profile page.

You may also send us an e-mail at info@spotswash.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of Spotswash are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
